Terms of Service

1. Acceptance of Terms

By accessing or using the HE365 platform ("Platform") operated by Hybrid Event 365, Inc. ("HE365," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

These Terms apply to all visitors, users, and others who access or use the Platform, including event organizers, attendees, exhibitors, sponsors, and community members.

2. Description of Service

HE365 provides a self-driving AI hybrid event platform that enables organizations to create, manage, and grow hybrid, virtual, and physical events and communities. Our services include but are not limited to:

  • Event creation, hosting, and management tools
  • AI-powered engagement and networking features
  • Community building and management capabilities
  • Virtual exhibition and sponsorship tools
  • Analytics and reporting dashboards
  • AI Agent Boot Camp and AI Prosperity Engine programs

3. User Accounts

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your password and for all activities under your account.

You must notify us immediately of any unauthorized use of your account. HE365 will not be liable for any loss or damage arising from your failure to comply with this section.

4. Acceptable Use

You agree not to use the Platform to:

  • Violate any applicable local, state, national, or international law
  • Transmit any material that is defamatory, offensive, or otherwise objectionable
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the Platform or servers
  • Attempt to gain unauthorized access to any portion of the Platform
  • Use automated systems to access the Platform without permission
  • Collect or store personal data about other users without consent

5. Intellectual Property

The Platform and its original content, features, and functionality are and will remain the exclusive property of Hybrid Event 365, Inc. and its licensors. The Platform is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written consent.

HE365, Community Capital, Community Growth OS, AI SuperPower Agents, AI Prosperity Engine, AI Agent Boot Camp, InstantX, and all associated logos are trademarks of Hybrid Event 365, Inc.

6. User Content

You retain ownership of content you submit, post, or display on or through the Platform ("User Content"). By submitting User Content, you grant HE365 a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such content in connection with operating and providing the Platform.

You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate any third party's rights.

7. Payment Terms

Certain features of the Platform require payment. All fees are stated in U.S. dollars unless otherwise specified. You agree to pay all applicable fees and authorize us to charge your chosen payment method. Fees are non-refundable except as required by law or as explicitly stated in your service agreement.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Platform will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive.

9. Limitation of Liability

In no event shall Hybrid Event 365, Inc., its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use, the Platform.

10. Disclaimer

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. HE365 expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms will be resolved in the state or federal courts located in California.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the Platform after any changes constitutes acceptance of the new Terms.
